1. Introduction

These Terms and Conditions ("Terms") govern the use of the Elite Tutoring Perth website and the provision of our tutoring services. By accessing our website, submitting an enquiry, booking a session, or engaging our services, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use our website or services.

 

2. Definitions

  • “We”, “us”, “our” refers to Elite Tutoring Perth

  • “Client” refers to the parent or guardian who engages our services

  • “Student” refers to the individual receiving tutoring services

  • “Services” refers to tutoring sessions, programs, and related educational services

 

3. Eligibility and Parental Responsibility

Our tutoring services are primarily provided to students under the age of 18.

By engaging our services, the parent or legal guardian confirms that:

  • They have authority to enter into this agreement on behalf of the student

  • All information provided about the student is accurate

  • They accept responsibility for payments, communication, and compliance with these Terms

 

4. Services Provided

Elite Tutoring Perth provides academic tutoring services, including one-on-one and small group tutoring, delivered in person, online, or via a hybrid format.

We reserve the right to modify, reschedule, or discontinue any service or program at our discretion, subject to reasonable notice where possible.

 

5. Bookings and Payments

  • All consultation sessions must be booked in advance

  • Fees will be communicated prior to booking confirmation

  • Payment terms may include upfront payment, package pricing, or scheduled invoices

Failure to make payment by the due date may result in suspension or cancellation of services.

 

6. Cancellations and Missed Sessions

To ensure fairness and tutor availability:

  • Cancellations or rescheduling require a minimum of 24 hours’ notice

  • Sessions cancelled with less than 24 hours’ notice may be charged in full

  • Missed sessions without notice are not refundable

  • Late arrivals may result in reduced session time without fee reduction

Exceptions may be considered at our discretion for genuine emergencies.

 

7. Refund Policy and Australian Consumer Law

We comply with the Australian Consumer Law.

You are entitled to a refund, replacement, or remedy where services fail to meet consumer guarantees.

Change of mind, scheduling conflicts, or lack of academic improvement do not automatically entitle you to a refund.

Where a refund is applicable, it will be assessed on a case-by-case basis.

 

8. Academic Results Disclaimer

Elite Tutoring Perth does not guarantee:

  • Academic grades

  • ATAR results

  • Exam outcomes

  • University entry

Academic performance depends on multiple factors including student effort, attendance, school curriculum, and individual ability.

Any examples of past results or testimonials are indicative only and do not constitute a guarantee.

 

9. Student Conduct

Students are expected to:

  • Behave respectfully towards tutors and staff

  • Engage constructively during sessions

  • Follow reasonable instructions provided by tutors

We reserve the right to suspend or terminate services without refund where behaviour is disruptive, unsafe, or inappropriate.

 

10. Online Tutoring

For online sessions:

  • Clients are responsible for ensuring reliable internet access

  • Technical issues outside our control do not guarantee refunds

  • Sessions may be recorded for quality assurance or tutor training, unless otherwise requested

 

11. Intellectual Property

All tutoring materials, worksheets, lesson plans, and resources remain the intellectual property of Elite Tutoring Perth.

Materials may not be copied, shared, resold, or distributed without written consent.

 

12. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential loss

  • Our liability is limited to the value of the services provided

  • Nothing in these Terms excludes rights under Australian Consumer Law

 

13. Privacy

Personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.

 

14. Termination

We reserve the right to terminate services where:

  • Fees remain unpaid

  • These Terms are breached

  • Continued service is not appropriate or feasible

 

15. Changes to These Terms

We may update these Terms from time to time. Updated versions will be published on our website with a revised effective date.

 

16. Governing Law

These Terms are governed by the laws of Western Australia, and any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
